A Bill for an Act to Amend the Sexual Offences Act

OBJECTS AND REASONS
This Bill seeks to amend the definition of ―rape‖ in section 3 of the
Sexual Offences Act to make provision for a person to be liable for the rape of his spouse regardless of whether the parties to a marriage were living apart at the time that the offence was committed. Consequently section 15 is
repealed.

This Bill also seeks to remove the time restriction of six months (imposed by the Criminal Procedure Code (Ch. 91)) for summary offences.

1. The proposed amendment to the Sexual Offences Act seeks to give stronger effect to The Bahamas commitment to strengthen its laws to eliminate violence against women.

2. In 1993, The Bahamas acceded to the United Nations Convention on the Elimination of All Forms of Discrimination against Women (CEDAW). In 1993 the United Nations General Assembly issued a Declaration on the Elimination of Violence against Women (“the Declaration”) with a view to strengthen and complement the
provisions contained in the Convention.

Utilities Appeal Tribunal Act 2009The Tribunal shall have exclusive jurisdiction to hear and determine all appeals, matters and disputes referred to it and shall have such original, appellate and supervisory jurisdiction as may be conferred upon it in relation to a regulated sector by the Utilities Regulation Competition Authority Act, 2009 or conferred upon it by any other law.
