Security Council Sanctions Committee concerning Yemen amends entry on its Sanctions List

Pursuant to section 43 of the Anti-Terrorism Act, 2018 (No.27 of 2018) as amended by the Anti- Terrorism (Amendment) Act, 2019 (No. 29 of 2019) and section 3 of the International Obligations (Economic and Ancillary Measures) Act, Chapter 16 (“IOEAMA”) as amended by section 3A of the International Obligations (Economic and Ancillary Measures) (Amendment) Act, 2019 (No. 27 of 2019), the National Identified Risk Framework Coordinator (“NIRFC”) has requested that the Registrar General of The Bahamas circulate the following Notice:

 

On 5 April 2021, the Security Council Committee on Yemen established pursuant to resolution 2140 (2014) enacted the amendments, specified with strikethrough and underline, in the entry below on its Sanctions List of individuals and entities:

Title: na Designation: a) Director, or General Manager, of the Criminal Investigation Department (CID), Sana’a based ministry of interior, in Sana’a, Yemen b) Brigadier DOB: na 5 Feb. 1986 POB: na Razih District, Sa’dah Governorate, Yemen Good quality a.k.a.: na Low quality a.k.a.: na a) Abu Saqar Zabin b) Abu Sagar Zabin Nationality: na Yemen Passport no.: na National identification no.: na a) Yemen national identification number: 10010095104, issued on 26 December 2013 b) Yemen military identification number: 20432 (issued in 2018) Address: na Sana’a, Yemen Listed on: 25 Feb. 2021 (amended on 5 Apr. 2021) Other information: Sultan Saleh Aida Aida Zabin has engaged in acts that threaten the peace, security and stability of Yemen, including violations of applicable international humanitarian law and human rights abuses in Yemen. Zabin has played a prominent role in a policy of intimidation and of use of systematic arrest, detention, torture, sexual violence and rape against politically active women. Zabin as director for CID is directly responsible for, or by virtue of his authority responsible for, and complicit in the use of multiple places of detention including house arrest, police stations, formal prisons and detention centres and undisclosed detention centres. In these sites, women, including at least one minor, were forcibly disappeared, repeatedly interrogated, raped, tortured, denied timely medical treatment and subjected to forced labour. Zabin himself directly inflicted torture in some cases.

All Legal Entities and Non-Profit Organisations (“NPOs”) are required to take the following steps:

  1. conduct immediate searches of their database and register of beneficial owners to determine whether there is any information in relation to the individuals or entities on the UN Security Council Sanctions List that are associated with Yemen and associated individuals, groups, undertakings and entities;
  2. report any “Hits” to the Financial Intelligence Unit and National Identified Risk Framework Coordinator at the Office of the Attorney-General immediately;
  3. advise the Registrar General of findings of Nil reports; and
  4. retain a copy of their “Hits” and Nil reports for record keeping purposes and evidence of reviews.
